Public contracting has changed. If until recently the public contractual model was characterized by its verticality and imposability, with the Public Power deciding alone and without any market participation the contracting conditions, increasingly has been recognized, in the market and in the public sector, the importance of consensuality as a means to improve contracting, thus admitting the direct participation of private initiative in the construction of the project.
